Terms and Conditions of Sale

The website thegoodcycle.fr is published by VISIO TOPIA, a simplified joint-stock company (SAS) with a capital of €1,000, whose registered office is located at 8 rue Saint Léon, 31400 Toulouse, registered with the Toulouse Trade and Companies Register under number 952 915 288 (SIRET 952 915 288 00015), intra-community VAT FR94 952 915 288.

The products offered for sale are described with the greatest possible accuracy (composition, characteristics, size guide). The photographs illustrating the products are not part of the contractual scope and the seller cannot be held liable for slight differences in appearance or color due to display settings. Products are offered while stocks last.

Prices are indicated in euros, all taxes included (TTC), excluding delivery costs. Delivery costs are specified before order confirmation. VISIO TOPIA reserves the right to modify its prices at any time, it being understood that the price applicable is the one in force at the time of order confirmation.

For orders whose value does not exceed the applicable threshold, import VAT is collected at the time of payment via the IOSS One-Stop Shop: no additional customs fees or VAT will be claimed from the Customer upon receipt of the package.

The Customer selects the products, adds them to their cart, then confirms their order after checking its contents. The confirmation of the order, after acceptance of these GTC and completion of payment, constitutes the conclusion of the sales contract. A confirmation email summarizing the order is sent to the Customer.

Payment is made online at the time of order, by credit card or any other payment method offered during validation. Transactions are secured by our payment provider. VISIO TOPIA does not store any banking data. The order is processed only after effective confirmation of payment.

Products are delivered to the address indicated by the Customer when placing the order.

Estimated delivery time: 10 to 15 days from order confirmation.

Delivery fees: Delivery is free for all orders in metropolitan France.

Should the advertised delivery time be exceeded, the Customer may, after having unsuccessfully urged the seller to deliver within a reasonable additional period, cancel the order and obtain a full refund of the amounts paid, in accordance with Article L.216-6 of the Consumer Code.

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to provide a reason.

Exception for hygiene reasons: in accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for items that have been unsealed after delivery and that cannot be returned for reasons of hygiene or health protection. Consequently, swimsuits, panties, and menstrual swimwear that have been worn, tried on bare skin, washed, or from which the hygienic protection has been removed, cannot be subject to withdrawal.

The right of withdrawal applies only to items returned in their original condition: unworn, unwashed, with their labels and hygienic protection intact.

To exercise their right of withdrawal, the Customer must notify their decision by e-mail to contact@thegoodcycle.fr, or by using the standard form at the end of these General Terms and Conditions of Sale.

In the event of a valid withdrawal, the Client shall return the products at their own expense within 14 days following notification of their decision.

VISIO TOPIA shall refund all sums paid, including initial delivery costs (excluding additional costs due to a more expensive delivery method chosen by the Client), within 14 days of receiving the returned products, or proof of their shipment. The refund shall be made using the same payment method as that used for the order.

The company reserves the right to refuse a refund or to apply a reduced refund in the event of an item being returned that does not comply with the conditions of Article 7 (item worn, washed, unsealed, or returned incomplete)

Notwithstanding any commercial warranty, the Customer benefits from the legal warranty of conformity (Articles L.217-3 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code). As such, the Customer may obtain the repair, replacement, or refund of a non-compliant or defective product.

VISIO TOPIA, in its capacity as seller, remains fully responsible for the performance of the contract and the conformity of the products to the Customer, regardless of the method of supply or shipment.

VISIO TOPIA shall not be held liable for damages resulting from improper use of its products or failure to comply with the indicated maintenance instructions. It cannot be held liable for any inconvenience or damage inherent to the use of the Internet (service interruption, external intrusion, presence of viruses).

Customer's personal data is processed in accordance with the Privacy Policy, accessible from the footer of the website.

All elements on thegoodcycle.fr website are protected by intellectual property law and remain the exclusive property of VISIO TOPIA. Any unauthorized reproduction is prohibited.

In accordance with Article L.612-1 of the French Consumer Code, consumers may have free recourse to the CM2C mediation service, to which The Good Cycle (Visio Topia) belongs:

The consumer may refer the matter to the mediator within one year of their written complaint to The Good Cycle, and after attempting to resolve the dispute directly with us.

These General Terms and Conditions are governed by French law. In the event of a dispute, and failing an amicable resolution, only French courts will have jurisdiction.
